1. Purpose and Multi-Vertical Ecosystem
Enllava is a digital technology intermediation and unified marketplace platform in the Dominican Republic, organized into three operating verticals: (a) Enllava Vehicles, for direct listing, sale, and purchase of cars, SUVs, pickup trucks, and motorcycles; (b) Enllava Properties, for listing, sale, and rental of residential, commercial, and tourism real estate; and (c) Enllava Businesses, for listing and transfer of small and medium commercial businesses and operational entities.
Enllava acts strictly as a technological intermediary and communications facilitator. Enllava is NOT the owner or seller of listed assets, does not act as a car dealership, real estate brokerage, financial broker, or public notary, is not a party to private user agreements, and does not guarantee that a transaction will be completed.
2. Registration, Accounts, and User Responsibilities
Browsing the Vehicles, Properties, and Businesses catalogs is completely free and requires no prior registration. To publish listings, save favorites to the cloud, or manage account tools, users must register with true, accurate, and up-to-date information.
Each user (individual seller, auto dealer, or real estate agency) is solely responsible for maintaining the confidentiality of their credentials and for all activities conducted under their account. You must notify Enllava immediately if you detect unauthorized access.
3. Specific Rules for Enllava Vehicles
All vehicle listings must correspond to real, existing units located within the Dominican Republic, with truthful specifications regarding make, model, year, transmission, fuel type, and genuine odometer mileage.
The seller warrants that the vehicle has a valid registration title (matrícula) and is free from undisclosed legal liens, seizures, or oppositions registered with the General Directorate of Internal Taxes (DGII). The parties acknowledge that official title transfer at the DGII, payment of the 2% transfer tax, and road tax (marbete) validation are the sole responsibility of buyer and seller.
Enllava does not perform mechanical inspections or chassis certifications. Buyers are required and strongly advised to perform an independent computer scan (OBD2) and physical inspection with a trusted mechanic prior to making payments.
4. Specific Rules for Enllava Properties
Real estate listings must accurately specify property type, province, sector, construction/lot square meters, number of bedrooms, bathrooms, parking spots, and price in DOP or USD.
Property owners and real estate agencies agree to list properties with clear legal status. Prospective buyers are advised to examine the Certificate of Title at the Land Registry (Jurisdicción Inmobiliaria), verify cadastral demarcation (deslinde) under Real Estate Registry Law No. 108-05, and confirm current property tax (IPI) status with the DGII.
Any earnest money agreement (arras), promise of sale, or rental deposit is executed privately between the parties via a private contract legalized by a Dominican Public Notary.
5. Specific Rules for Enllava Businesses
Business transfers must reflect good-faith declared financial metrics (asking price in DOP, commercial rent, estimated inventory, declared revenue, and net profit).
The seller must obtain written landlord authorization for commercial lease assignment and confirm that no labor liabilities or severance claims exist with employees at the Ministry of Labor and TSS.
6. Pricing, 0% Commissions, and Optional Verification Services
Standard listing on Enllava is 100% free of charge. Enllava does not charge percentage success commissions on closing values between individuals, dealerships, or real estate agencies.
Enllava offers optional documentary verification services (Tier 1 and Tier 2) and institutional profiles. Purchasing or canceling these optional features does not delete the listing, which remains active as a standard free listing.
7. Intellectual Property, Copyright and Content License
The Enllava brand, visual identity, source code, platform, and algorithms are the exclusive property of Enllava protected under Dominican intellectual property laws.
By uploading photographs, media, or listing data of vehicles, properties, or businesses, the user or seller warrants possessing full rights and licenses over said assets, granting Enllava a non-exclusive, royalty-free, territorial license to host, adapt, index, and publicly display such content on the platform.
Enllava expressly reserves the right to select, feature, and utilize high-quality photography submitted in active listings as dynamic hero backdrops across ecosystem portadas, editorial mosaics, featured carousels, and platform promotional marketing, with the purpose of enhancing portal aesthetic standards and maximizing commercial visibility for listed assets, without incurring additional compensation.
8. Content Removal and Fraud Prevention
Enllava reserves the right to immediately take down any listing with altered mileage, forged titles, nonexistent businesses, or scam attempts, suspending the violator’s account without compensation.
9. Governing Law and Jurisdiction
